T-Biz ART End User License Agreement

Carefully read all the terms and conditions of this Agreement before using T-BIZ ART. Use of T-Biz ART means you agree to the following license agreement.

License:  This non-exclusive, non-transferable license is given by T-Biz Network International, LLC, USA, with respect to artwork called T-BIZ ART - whether that artwork is part of a collection on CD or DVD, or as a single digital downloaded art file. You may use T-Biz ART for any graphic purpose on a product made by you, including images on T-Shirts, garments, print media, internet websites, and multi-media with the following restrictions:

If used on a product, this license is limited to overall print production runs of 20,000 or less units. If an overall production run exceeds 20,000 units - an additional license fee for “mass production” will be required.

You cannot sell these images as a collection of artwork or offer them for resale as digital images.

You cannot post these images on any online service, database, computer bulletin board/forum or other electronic transfer medium, other than as samples of images you have created using this artwork.

These images cannot be copyrighted or trademarked as stand alone images.

These images may not be incorporated into a logo, trademark or service mark.

You may have these images reproduced on product by sub-contractors as long as they agree to the conditions of this license agreement.

You are permitted to copyright a composite image using any T-Biz ART as one of the components but the copyright will only apply to the non-T-Biz ART portion of the graphic image.

If you post these images on a company network for other company employees to use you can post them to no more than 10 workstations/computers.

Limited Warranty and Liability:  No implied warranty (or condition)* as to the quality or performance of T-BIZ ART, including any warranty (or condition)* of merchantability or fitness for a particular purpose, is given for T-BIZ ART, and all such warranties are expressly disclaimed (except for implied warranties on the disks which are limited in duration to the ninety (90) day period described above).

These images are provide "as is" with no guarantee as to the quality of the images.

No other warranty or guaranty given by any person, firm or corporation with respect to T-BIZ ART shall bind T-Biz Network International, LLC or anyone else who has been involved in the creation, production or delivery of the program (some States or Provinces do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you).

You understand that you are granted no rights or given no warranty with regard to the use of names, trademarks, trade dress, registered, unregistered or copyrighted designs or works of art of architecture depicted in any of the graphic images in T-Biz ART.

Neither T-Biz Network International, LLC nor any other person, firm or corporation is responsible for the loss of revenue or profits, expense or inconvenience, or for any other special, incidental or consequential damages caused by the use, misuse or inability to use T-BIZ ART whether on account of negligence or otherwise, or by failure to confirm to any express or implied warranties or conditions (some States or Provinces do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you).

This limited warranty shall not extend to anyone other than the original user of the Software.

In no case shall the T-Biz Network International, LLC’s liability exceed the purchase price for the artwork, or CD/DVD. The disclaimers and limitations set forth above will apply regardless of whether you use the images or not.

Indemnity: You agree to indemnify and hold harmless T-Biz Network International, including affiliate and subsidiary companies and their respective directors, officers, employees and agents, against any claim for damages, losses or any costs, including attorney’s fees, arising in any manner whatsoever from the unauthorized use of any of the T-Biz ART images by you, or by a breach of any terms of this License Agreement.

Copyright:  All T-Biz ART is copyright by the original artist or T-Biz Network International, LLC. All rights reserved.

Acknowledgment:  By using T-Biz ART you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. 

You also agree that this Agreement is the complete and exclusive statement of Agreement between the parties and supersedes all proposals or prior Agreements, verbal or written, and any other communications between the parties relating to the subject matter of this Agreement.

No amendment to this Agreement shall be effective unless signed by an authorized officer of T-Biz Network International, LLC.                                                       .

Modifications to Agreement:   This Agreement will be governed by the laws of the State of Arizona. This Agreement may only be modified by a license addendum which accompanies this license or by a written document which has been signed by both you and T-Biz Network International, LLC.
